Man sues two deceased rappers for uncleared sample

Richard Jaden Hoff claims his guitar riff from his Soundcloud song, "Under My Breath" was used as an uncleared sample in Lil Peep and XXXTentacion's song "Falling Down", specifically that the riff was looped, sped up, filtered and equalized but still remained similar enough to his song.

Hoff posted his song on Soundcloud in June 2018, "Falling Down" was released in September 2018, with a Travis Barker remix released in July 2019. The song has over 20m plays on Spotify and over 21m views on YouTube. The single also hit No. 13 on Billboard's Hot 100.

Lil Peep died in November 2017, and XXXTentacion died in June 2018, 5 days after Hoff released his Soundcloud song. Among the record labels being sued, Hoff is also specifically suing the rappers and NOT their estates, even referring to them as residents of California.
