Lawsuit Battle: Forever 21 vs Gucci, Adidas, and Puma

The Fashion Law reports that Gucci and Forever 21 have been at each other's throats since December 2016. It all started when Gucci caught wind of Forever 21 selling items with their trademark striped colors on them. So they sent a cease and desist to Forever 21. Forever 21 has decided to hit back with their own suit and so much more as this legal drama continues.

"Gucci should not be allowed to claim that Gucci, alone, has a monopoly on all blue-red-blue and green-red-green striped clothing and accessory items." -Forever 21 lawsuit

An example of the items Forever 21 was being sent cease and desists for

*) Forever 21's lawsuit was filed in the U.S. District Court for the Central District of California
*) Forever 21 calls itself an "American success story" in its suit
*) Gucci's cease and desist wanted Forever 21 to stop all sales of items with their registered trademark blue-red-blue and green-red-green stripes.
*) Gucci sent Forever 21 a total of 3 cease and desists from December 2016 - February 2017, threatening legal action
*) Forever 21 responded to the C&Ds by filing a declaratory judgment action against Gucci
*) Forever 21 demanded that Gucci's registered trademarks and any other upcoming applications for trademarks be canceled
*) Gucci issued a statement exclusively to The Fashion Law stating that Forever 21 is well known thief.

Forever 21 asked a Californian judge to decide the case. Said judge decided that Forever 21 had no case and dismissed the lawsuit. But that wasn't the end.

*) Forever 21 filed a amended complaint wanting to prove that various other brands use similar designs to Gucci
*) STILL wants Gucci's trademarks canceled and the right to sell their items they think won't trick consumers they are actually Gucci items.
*) Gucci gave a statement exclusively to The Fashion Law that basically they're tired of Forever 21's nonsense

The mall chain retailer, Forever 21, has also tried it with another company, Adidas.

*) Forever 21 filed a similar suit as they did with Gucci, accusing Adidas of "bullying"
*) Forever 21 stated they were tired of designing and selling items with "a cloud" over their head

Forever 21 has also had another suit filed against them this year by Puma.
*) Puma said Forever 21 has copied items from their Rihanna's Fenty collection
