Daily Mail apologises and pays 'substantial damages' to JK Rowling

The Daily Mail has printed an apology to the author JK Rowling in which it states that it has paid her substantial damages over an article that claimed she had told a misleading "sob story."

The article, published on 27 September 2013, suggested she had falsely accused churchgoers of stigmatising her because she was a single mother. It was headlined "How JK's sob story about her single mother past surprised and confused the church members who cared for her."

The paper admitted liability in January, when it agreed to publish the correction and pay damages to Rowling. But the Mail disputed details of the settlement.

In the high court last month, Mr Justice Tugendhat that Rowling could make a statement about the case despite objections from Associated Newspapers, the Mail's publisher, about the contents of the statement.

He ruled that "there is no sufficient reason" for refusing Rowling permission to read it.

Wednesday's apology, at the foot of page 2, states:

"Our September 28, 2013 article 'How JK's sob story about her single mother past surprised and confused the church members who cared for her' suggested that JK Rowling made a knowingly false and inexcusable claim in an article for the Gingerbread charity that people at her church had stigmatised her and cruelly taunted her for being a single mother.

In fact Mrs Rowling recounted only one incident where a visitor to the church sitgmatised and taunted her on a particular day. We accept that Ms Rowling's article did not contain any false claims and apologise for any contrary suggestion and have agreed to pay substantial damages to Ms Rowling, which she is donating to charity, and a contribution to her legal costs."

I mean I know we have slander suits but liable is practically impossible to prove here in the states as all you have to say now is, "a close source" or "a close friend"

and then you have that messy word "allegedly" which basically gives the breathing room to say almost whatever the fuck you want

In theory yes, in practice not so much for celebrities. Since NYT v. Sullivan the person suing has to prove malice/that they knowingly disseminated false information with the intent to harm, which is nearly impossible and rarely happens. With private individuals it's a different story.

and if a publication uses the words like "allegedly" then they can claim that they didn't publish a story as fact but instead as "journalistic speculation" because its their jobs as "journalists" to ask questions

like Nancy Grace basically makes a killing off of doing this because she never really accuses people of anything on her show, all she really does is ask damaging questions that paint them all colors of guilty

It's really hard to sue for slander/liable here. You have to prove intent which is nearly impossible. And it's really easy for new-sources to get around things by saying "allegedly" like..."allegedly racist comments" or "allegedly beat his wife". So ridiculous.

Well for public figures like JK that is. A private citizen like you or me would only have to prove something untrue and damaging to reputation was published in the news.

I heard she wrote the series on a napkin during a train ride. I've heard so many different stories when it comes to Rowling and the creation of HP.

the only one I can remember is that she used plain paper notebooks and wrote it at a coffee shop

also that she mapped out the entire seven books right at the beginning

Yeah, that's what I heard, and that she wanted to get a job, but then she wouldn't be able to get government assistance, and she would have more money with government assistance than with a job, so she couldn't afford to get a job.

She says here it was because she couldn't afford childcare. If she had childcare she would have been able to work enough hours to get by, but as it was she worked the few hours she could and had to be careful the tiny bit of pay wasn't enough to lose her benefits but be no better off.

iirc she canned that for pottermore since (i guess) she preferred to give away that information for free? but if pottermore tanks (i have no idea how it's doing) maybe she'll go back to it.

i think it's slowly tanking. i know it tanked for the older fans who grew up with HP, but i think it's starting to dwindle down for younger fans as well, especially when it takes like freaken 5 months for them to create the next 5 chapters for each book

My problem with it is I have no interest in playing through all the level and making stupid potions to get through to new pieces of information. Don't get me wrong, when I was nine I would have been all over that, but now I've moved on. Once I got sorted and found out the wands were randomized, I just read the extra info elsewhere online.

You don't have to make potions though. You have an option of making them if you want. But it's so hard anyway I don't know why anyone would want to.
