GABRIEL AUBRY Rushes to Court I Want My Daughter Back!

Gabriel Aubry is rushing to family court today ... asking a judge to lift the order prohibiting him from seeing his daughter in the wake of the Thanksgiving day beatdown ... TMZ has learned.

TMZ broke the story ... after Gabriel was arrested for battery ... a judge issued an emergency protective order blocking Gabriel from coming within 100 yards of Halle Berry, Nahla and Olivier Martinez.

We're told Gabriel's lawyers will argue Olivier instigated the fight, beating the model to a pulp in Halle's motor court and even repeatedly slamming his head on the concrete.

We're told Halle's lawyers will be in court this morning to oppose Gabriel's motion ... and Halle may show.

Gabriel obtained a restraining order Monday against Olivier.

He is her fiancee, he can do that...and honestly if Gab can't hold back enough to allow that and not get angry, HE IS THE PROBLEM. Olivier will soon be Nahla's step daughter, HIS DAUGHTER too.

I personally don't want to go fully off reports, but it's obvious Gab threw the first punch from all sources. I can't believe you're defending a man who COPS have even said has a temper. LIKE WHAT?

Who gives a fuck if he's her fiance? He is not the fucking father of that child and knowing the animosity that exists between them and the fact that prior to this, Nahla has ALWAYS been received by a third party, it is sketchy as fuck that Olivier decided that on this day, he HAD to go and get Nahla from Gabriel.

And of course he fucking has a temper - this man who had NOTHING to do with bringing that little girl into this world or raising her is trying to rip Gabriel's rights as her BIOLOGICAL father away from him and take his fucking daughter to another country so he can't see her. Oh, I'm sorry, how DARE someone be angry that some guy is trying to cut him out of his fathers life.

No one is saying Gabriel is a saint, but again, self defense is not what Olivier did and the fact that he can cause that much damage to a person shows that HE is the one with severe anger and violence issues.

And spare me that shit that Nahla will be Olivier's daughter soon. Please. For one, Halle has a terrible track record with men, and just because he marries her mother for however amount of time does not mean that he has any more rights to her than the guy who is biologically her father and who is fighting tooth and nail to keep his rights to her from two people who are determined to cut him out just because Halle is over him

just fyi tmz gets everything from halle herself so it's not exactly neutral. we don't know who started it, we don't know what happened, all we know for sure is how fucked up gabriel aubry looks.

I do think that Gabriel started the fight after Olivier provoked him. He probably pushed Olivier to the side. Something like that can happen and it's not acceptable. But being pushed doesn't mean that you're allowed to beat someone like that. That's not defense. It's like a woman pushing a man. Olivier was stronger.

Your comment makes no sense. There's no way in hell Olivier used reasonable force, which is the only kind the law allows for self defense. And he has ZERO rights or say to Nahla as of now.

I feel like no one here has seen a fistfight and doesn't know how they work. Gabe started it and Olivier finished it. The onus is on Gabriel for reacting violently FIRST, whether he was verbally provoked or not.
