GABRIEL AUBRY Rushes to Court I Want My Daughter Back!

Gabriel Aubry is rushing to family court today ... asking a judge to lift the order prohibiting him from seeing his daughter in the wake of the Thanksgiving day beatdown ... TMZ has learned.

TMZ broke the story ... after Gabriel was arrested for battery ... a judge issued an emergency protective order blocking Gabriel from coming within 100 yards of Halle Berry, Nahla and Olivier Martinez.

We're told Gabriel's lawyers will argue Olivier instigated the fight, beating the model to a pulp in Halle's motor court and even repeatedly slamming his head on the concrete.

We're told Halle's lawyers will be in court this morning to oppose Gabriel's motion ... and Halle may show.

Gabriel obtained a restraining order Monday against Olivier.

The worst part is that you can really tell that he wants to be part of her life (which doesn't happen nearly often enough with some other dads.) Halle should be thankful tbh.

Maybe I'm projecting too much (my dad died when I was 8 and my mom never remarried so I've never had anyone fight to be my dad, let alone a dad in the first place) but that's how I feel exactly.

It's crazy because Halle has said not having a father in her life made things very difficult for her, so it's shocking to see her being okay with Gabriel not being a part of Nahla's life.

Apart from being, you know, a decent human being for wanting to be an active parent.

If what was said in another post is true (that Gabriel grew up in foster homes) it explains how adamant he is in being involved in Nahla's life.

IDK much about his life thou.

I looked him up after I read that, and it said something like he had 10 siblings or something and he lived with five different foster families from age 3-18.

What struck me was that it also said he didn't live with his father until he was 18, when he had already begun modeling. I don't know, it seems to me he grew up without a stable father figure and wants to be that for his daughter.

Halle should've consider that before choosing him as the father of her daughter if all she wanted was a child all for herself.

Just because she grew up without a father figure and thinks she came out alright and that Nahla can be alright too without hers, doesn't mean Gabriel shares that thought.
