GABRIEL AUBRY Halle Berry's Fiance THREATENED TO KILL ME!



Gabriel Aubry has obtained a restraining order against Halle Berry's fiance Olivier Martinez, who busted Gabriel's face during a brutal brawl on Thanksgiving ... and Gabriel's declaration (which includes graphic photos of his injuries) paints a radically different picture of what went down at Halle's on Thursday.

According to Gabriel's declaration, the day before Thanksgiving, Gabriel took Nahla to her school play. Halle and Olivier showed up and Olivier walked up to Gabriel and whispered in his ear in French, "I wish I could beat the s**t out of you right now. You're lucky we're in a school right now. We're going to take Nahla right now and you're not going to follow us."

The next day, Gabriel says he took Nahla to Halle's at around 10 AM. He says in a completely unusual move, Olivier came out of the front door -- usually the nanny was the go-between. Gabriel claims Olivier said, "We need to talk." Gabriel says he walked toward his car to close his door when Olivier jumped off the stairs and knocked Gabriel to the ground and started brutally beating him, screaming that Gabriel cost them $3 million to fight the custody war (Halle's failed move to take Nahla to Paris).

Gabriel says Olivier took his head in his hand and slammed it on the concrete driveway.

I don't think you could say that for sure, a person could technically be the aggressor if they pushed someone and the person then beat the crap out of them but who knows what happened in this situation.

Aubry could have been the aggressor; but Olivier (an ex-boxer) may have gone beyond the bounds of 'reasonable force' during the fight (just looking at the photos here). And with his professional fighting past, the law will be tougher on him, as they will have expected him to show some control and restraint with his skills.

If Aubry was the aggressor, Olivier had the right only to direct violence at Aubry necessary to protect himself (or family members). That would include fighting back to the point of stopping Aubry or incapacitating Aubry by holding him or pinning him down until authorities arrived. Once the threat to Olivier's safety is gone (Aubry has stopped fighting, is pinned down, has run away, has verbally asked him to stop, etc...) Olivier is no longer entitled to continue fighting.

If he continues to fight, just one extra punch...that is 'excessive force''.

Idg why everyone claims he's an ex-boxer, his father was a boxer... But that doesn't mean that he himself can box anymore than it means that I can prescribe medication cause my father was a doctor. smh.

Reading this, it sounds like Oliver could be controlling Halle, not Halle controlling everyone else. There's no reason he should get so aggressive about the situation when it doesn't pertain to him.

Olivier's hand looks pretty fine to me to be honest. My brother broke his hand once in a door - not even a bad break - and it was this swollen mess of bruises and grossness.

yeah there was a post from the day after and his hand was pretty swollen. but its probably not that bad because oliver decided to slam his head into the concrete instead of using his fist.

See, the issue I always have with the idea that Awbry is lying is that his stories always seem to have a coherent timeline and be plausible, while the reports from Halle's witnesses-etc always have huge gaping plot holes and don't make sense given how humans behave. :/ This report? Is scary as fuck and seems totally plausible.

I don't know all of the accusations that have been put against him, but I do know that the stuff with the nanny was dismissed.

i don't think so. The only one that could have been true (maybe it is idk) was that he got abusive with the nanny but that was thrown out due to lack of evidence.

This is crazy. I believe Gabe.

Olivier has proved to be a hot head and he's probably pissed that his Miami restaurant has been fined for being gross. Plus he probably is tired of Halle nagging him about Gabe or even annoyed with the entire situation.

He doesn't have a great reputation when someone else life is going through drama such as his ex when she battled cancer.

Good for Gabe.

Poor Nahla needs to be out of that home as long as Olivier is living their.

I also believe it because historically Halle has been attracted to abusers/physical men. Some women just can't stay away from guys like that.

At this point I pretty much believe that they're both abusive. Hell, the second Olivier started dating Halle I thought that just given her track record. I hope she breaks the cycle one day and gets out of abusive relationships.

GA's attorney was smart. He took pictures of his hands - which were normal looking. No swelling, no cuts nothing. Really, it looks like GA was jumped but where's the truth? It happened on her property, witnessed by her people. This is sad sad sad for the little girl.
