Photo Follow Up From The Thanksgiving Fight at Halle Berry's haus

While Gabriel Aubry has gone to ground following the dramatic Thanksgiving brawl, his love rival and opponent Olivier Martinez was spotted making an early-morning visit to the liquor store.

Martinez, 46, opted for a half-hearted disguise by wearing a cap, but was nevertheless prepared to face the photographers on his 'victory walk' - after apparently coming off better than Aubry in yesterday's fight.

Still, Olivier's hand appeared to have swelled some more overnight - and looked bloated and painful as he stopped by Gil Turner's Fine Wine & Spirits in Los Angeles on Friday.

Later on Friday Halle was snapped taking Nahla to see a show at the Nokia Theatre in Downtown Los Angeles.

Gabriel, 37, meanwhile, was pictured being whisked out of LAPD's Downtown jail in Los Angeles on Thursday night.

He had a contingency in place for the photographers, though, cowering from the flashbulbs under a blanket in the backseat of an SUV as he was driven away.

Bail Bondsman David Perez of David Perez Bail Bonds paid Aubry's $20,000 bail - before picking him up at around 6pm.

Aubry - father of Halle Berry's daughter Nahla - was charged with battery and taken into custody upon his discharge from hospital at around 3.30pm on Thursday - where he was treated for a broken rib and bruises to the face.

His booking sheets lists him as 6ft2 and weighing 180lbs.

The pictures emerged as fresh details of the horrific fight between Aubry and Martinez continued to unravel.

Nahla was apparently saved from witnessing the full brutality of the fight - after Halle rushed her inside the house as the two men started to face off, TMZ reports.

However it is unclear if she did witness some of the fight.

It was initially reported the brawl happened inside Halle's house - but it is now claimed the altercation played out in the large driveway, according to the website.

After Olivier said to Gabriel 'We have to move on,' the Canadian model is said to have retaliated and pushed the French actor and tried to punch him before a full blown fight broke out.

Gabriel and Halle - who split in 2010 - have been at odds ever since she tried to convince a judge to allow her to move to France with Nahla, a move which was recently blocked by the courts.

On Thursday a judge issued an emergency protective order in the wake of the melee - meaning Gabriel must stay 100 yards away from Halle, Olivier and Nahla.
Onlookers told TMZ the fight was 'brutal', with the website describing a blow-by-blow account of the melee.

Under cover: Gabriel Aubry hid his gangly frame under a blanket as he left jail on Thursday, hours after being charged with battery over a brawl with love rival Martinez

Making a getaway: The model's bail was posted by a bondsman, who collected Aubry in a white SUV

A source said: 'Olivier blocked [Gabriel's punch] and the punch struck him in the shoulder instead... Gabriel then pushed Olivier to the ground, a struggle ensued, ending when Olivier pinned Gabriel to the ground.'

Olivier performed a citizen's arrest on his love rival, before police were called to the scene and arrested Aubry for battery.

Meanwhile, Olivier also required hospital treatment - and arrived at the Cedars Sinai Hospital around an hour after Aubry.

The model-turned-actor was later pictured leaving the hospital, with Halle and Nahla in tow, and took the wheel of the car despite sporting a swollen hand, which he may have fractured during the fight.

I honestly wonder where all of you Gabriel-supporters are getting this bullshit. "We need to move on" is much more likely to have been "Let's get past this ugliness between us and try and make peace" than "YOU need to move on and never see your child again." I mean, my personal assumption is that Olivier made an ill-advised move to try and make peace, possibly in part because it was Thanksgiving. That's just supposition, but certainly if the reported wording is correct that suggests that Olivier was trying to make things better and Gabriel was not having a piece of it. If that's the case it was probably a bad idea in retrospect. But this shit about Olivier telling Gabriel to move on "from his child" is a complete butchering of what is being reported.

I think Gabriel is a fucking moron and a half and should be charged with assault so I don't know where you're getting that I'm a Gabriel supporter. You seem mad though. As an unlicensed medical doctor I recommend 2 chill pills and a nice hot bath.

I'm getting that you're a supporter from the mis-quote. And ah, "calm down" - any ONTD commenter's answer when they're called out and have nothing of use to say.

Dude- I'm just using the information from pretty much the ONLY source at this point, from what seems to be the witness accounts. I will gladly admit that I'm wrong if there is more solid evidence that's released later.

Are you happy now? Will that help you sleep at night?

If you use info from a source, you should use the actual info not the version you've made up. "We have to move on" not "you have to move on from your child." See the difference that makes? And I'll sleep like a baby now, thanks for the concern.

As someone said below, I was thinking of the comment in context of the situation. Whether or not it's accurate, I don't think we'll get to find out. But I'm glad to hear that. This post seems to be raising a lot of ire. Bad for blood pressure.

LOL, indeed. We're all just guessing here, but changing the quote the way you did and a lot of other people are really plays into a narrative that people really want to believe is true: that Halle's a crazy bitch and Gabriel a perfect father and she's trying to take his kid away. And I'm reacting to that because there's a lot of sexism and racism tied up in the way Halle is perceived, whereas any actual evidence we have doesn't paint Gabriel in a very good light. What we know of the actual quote from witnesses suggests to me that Olivier was trying to make peace on Thanksgiving. That's just my interpretation of course, but at least it's an interpretation based on the actual words quoted, not just what I imagine them to have been. Regardless of what was said, Gabriel started the physical fight and has been charged and I imagine a shit day was had by all.

because halle is trying to take nahla out of the country to be with thsi guy. there is context. (not rly supporting either btw)
run_atreyu 24th-Nov-2012 03:40 am (UTC)
What does that have to do with saying "we have to move on"? He isn't quoted as saying "you have to move on". Does ONTD understand language? (Not directed at you, I'm just really bemused as to how easily people are deliberately twisting what is known in order to serve their own agenda, but I guess that's people for you).

Obviously there are custodial issues here, but that doesn't make Olivier the aggressor. And since most of the claims that he is are coming out of a mis-quote of what he said, I think that's very unfair. Honestly, who knows exactly what played out here, but based on what we do know there is some evidence that Gabriel just lost it and a possibility that Olivier perhaps stupidly tried to approach him but shouldn't have. That's it, as far as evidence goes. And even if Olivier shouldn't have approached Gabriel, that's no justification for the nasty physical fight which ensued.

Edited to add: we do know one other fact - police have charged Gabriel with battery and not Olivier and a judge has put a protective order in place. All evidence points to Gabriel having been in the wrong here.
