Kelly Rutherford: Broke with no kids

She has said she is living a mother's worst nightmare in the wake of her ex-husband's win in their child custody case.

And Gossip Girl star Kelly Rutherford looked tense and frail as she joined her supportive brother for lunch in New York on Monday.

The 43-year-old was stylishly dressed in a fawn coat and boots, and although she hid her eyes behind dark sunglasses it was clear the fight over her young children is causing immense strain.

The Melrose Place actress broke down on The View as she discussed a ruling that would allow ex Daniel Giersch to keep their son and daughter, ages five and three, in France.
But the US-based mother-of-two, who has vowed to appeal, said she has drained her earnings to pay off legal bills - and must keep working to afford the fight.


Rutherford, who married the German businessman in 2006, separated three years later when she was pregnant with their second child, and divorced in 2010.

A bitter custody battle ensued, and on August 28 Los Angeles Judge Theresa Beaudet ruled the children should remain in France with their father, who they'd been visiting over the summer.
Complicating matters, Giersch's visa was revoked earlier this year and he has been banned from entering the US.

As a result, the couple will continue to have joint legal and physical custody with Rutherford required to fly overseas for visitation.
'I have to keep working to be able to afford this [the custody battle].
'I have been through pretty much everything,' Rutherford said. 'It’s just been crazy.'
The judge gave custody to Giersch as it was her opinion that Rutherford had repeatedly tried to cut her ex-husband out their children's lives.
Rutherford said she is consulting with lawyer Alan Dershowitz to get the children, who are American citizens, back to the US.

this is what i read:

In April of this year, for reasons not entirely clear, Giersch’s American visa was revoked, he was forced to leave the country, and moved to Monaco.

It is clear that a former lawyer for Rutherford had conversations with the State Department about certain issues related to Giersch’s “businesses” that ultimately led to him being booted.

Rutherford denies she knew anything about it, Giersch insists she did, but regardless the State Department determined there was enough evidence to deport him.

so if the State Department thinks that he should be deported why would a judge give custody to someone who seems suspicious? this makes no sense to me.

This is so fucked up. I'm not completely versed in custody law, but for the judge to let her ex keeps the kids, who are American citizens, while he's banned from entering the country where their mother lives... that's just extreme

The judge was also giving her shit about spending so much time in NY when her official residence is listed as LA. Even though she was doing that due to work on GG.

Most fathers that travel for work purposes wouldn't get that kind of scrutiny.

didn't you get the memo? 99.9999% of the time the mother gets the kids even if she's lazy and something something something. or if the dad is a saint, it doesn't really matter. cuz the mom still gets the kids like almost all the time.

Did you not read the article, I mean I don't 100% agree with the judge either but the reason he gave is because Kelly Rutherford repeatedly tried to cut the father out of her kids lives and that showed that she wasn't responsible as their guardian.

Is that taking into account the fact she had to work in NY for GG? I don't know but I think the judge would have been aware she had to travel for work. I don't think we are getting the full story.

i really hope that if i do get married and something goes wrong that we both can swallow our pride and just try to be cordial for the children. unless the other person clearly has some issues... this situation probably is not best for the children

My parents can't really stand each other. So I sometimes joke I made things easier for my mom because I cut my dad off for like three years. So she had to deal with him a lot less in those 3 years than she probably would have had to otherwise.

You can work agreed custody plans (ie 'not necessarily strict schedules, but goals for custody') into pre-nups. To be honest, it's a discussion you should have before you get married: if we were to split up, do you think it's better for the kids to live primarily with one parent, or split custody?

Last time I heard of a mom losing full custody, it was that nutter who had Naveen Andrews' baby. She had claimed in court that he and Barbara Hershey were using witchcraft to get her. In which case I don't blame the judge from yanking that kid away (although people were moaning on Celebrity Babies "it's wrong to take away her parental rights, no matter what." wtf)

if she really i broke that is a testament to how much this has cost her, this woman was a queen of TV throughout the 90s2, she was in Kindred, The Embraced and Brisco County, and everything else. I remember her from soaps in the late 80's. This custody battle must be tremedously expensive for her, I feel really bad for what she is going through right now
