Katie Holmes is playing hardball in her divorce battle against Tom Cruise.
The actress' lawyers have reportedly filed for an emergency custody and child support hearing in New York.
The paperwork was filed Tuesday by Katie's attorney Allan Mayefsky, RadarOnline.com has exclusively learned.
A hearing on the filing, called an emergent application, has been set for July 17 before Judge Matthew Cooper.
"Paperwork regarding Suri's custody was filed yesterday," a source close to the situation confirms to RadarOnline.com.
As we've reported, Cruise is being represented by Dennis Wasser, one of L.A.'s top divorce lawyers. He's likely already brought on a New York firm to coordinate on the case in the Empire State.
Both Tom and Katie reportedly will have to appear in person July 17.
“Tactically we can't say where Tom will file a divorce case and if he'll be seeking joint custody of Suri. We are letting 'the other side' (Katie and her team), play the media until they wear everyone out and then we'll have something to say. It's not Tom's style to do this publicly. He is really sad about what's happening.
