After five years of marriage, Tom Cruise and Katie Holmes are getting a divorce, PEOPLE has learned exclusively.
"This is a personal and private matter for Katie and her family," says attorney Jonathan Wolfe. "Katie's primary concern remains, as it always has been, her daughter's best interest."
Cruise's rep tells PEOPLE: "Kate has filed for divorce and Tom is deeply saddened and is concentrating on his three children. Please allow them their privacy."
The Rock of Ages star, 49, wed actress Holmes, 33, in an Italian castle in November 2006. They have daughter Suri, 6.
This was Holmes's first marriage and the third for Cruise, who previously was married to the actresses Nicole Kidman, with whom he has two children, and Mimi Rogers.

Ordering takeaway and booze and settling in.
Usually they go on and on about how it was a "mutual decision" and the both still "love and respect" each other, but just saying Tom is deeply saddened.... Makes me think that he's either kind of blind sided by this, or that the 5 year contract thing is TRUE.

This celebrity couple’s pre-nuptial agreement required the wife to stay in the relationship for a certain amount of time. However, the Stepford Wife’s law firm has decided that it may be difficult to impossible for the husband to enforce this. It seems that the wife knows much more than she should about the husband’s long-time and very personal relationship with another high-profile man. She is using that knowledge to get her sentence reduced and to to gain custody over the couple’s kid/s. It’s still not Nicole Kidman.
