No, not that one, this one.
Madonna’s accused stalker heard the sweet sound of freedom Tuesday when a judge tossed out weapons charges against him.
Robert Linhart, 61, was busted in September 2010 when cops found a knife in his fanny pack and an ice pick in his truck outside the Material Girl’s Central Park West pad.
A Manhattan judge dismissed the case Tuesday based on speedy trial grounds.
Linhart's lawyer, Kevin Kitson, did not immediately return calls for comment.
Manhattan District Attorney Cyrus Vance's office also had no immediate response, but court records show that witnesses were unavailable, forcing prosecutors to break time limit rules.
Linhart, a retired FDNY firefighter, returned to the sidewalks near the singer’s home after he was initially arrested with signs professing his love for her, cops said.
"I won't stop until I actually meet Madonna," Linhart allegedly told cops after his arrest. "I am going to go right back there and do it again."
Kitson has said Linhart, a grandfather and 21-year FDNY vet who lives in upstate Huletts Landing near Lake George, never should have been arrested or indicted.
"The New York City Police Department in this case was a servant of the private security of Madonna, doing a celebrity's bidding," Kitson charged. "If you have enough money and power, the rules are different."
The comments came at Linhart's last court appearance in January, at which he turned down a plea deal that would have required he serve a year in jail.
Linhart was out of prison on $20,000 bail.
The moral to this story according to many involved: Madonna, stop being so stalk-worthy. Sick.
