Actor Lane Garrison plans to plead guilty on Monday to vehicular manslaughter without gross negligence and two other alcohol-related charges that could result in a sentence of nearly six years in prison, his lawyer tells PEOPLE.
Harland Braun says Garrison will admit that he provided alcohol to minors, that he registered a blood alcohol level of over .15 and will plead guilty to one count of felony DUI with bodily injury.
"What's unusual in this society is he is admitting full responsibility – that's a breath of fresh air," says Braun.
Judge Eldon Fox is expected to hand down Garrison's sentence in July. He faces five years and eight months behind bars, but the actual length of his sentence could be reduced by half for good behavior, according to Braun.
Garrison, who played Tweener on the FOX jailhouse drama, Prison Break, was driving his Land Rover SUV in Beverly Hills with three teenage passengers on Dec. 2 when the vehicle struck a tree at 11:52 p.m.
One passenger, Vahagn Setian, 17, was taken to Cedars-Sinai Medical Center where he was pronounced dead. A 15-year-old girl, also in the car, suffered a fractured pelvis and shattered arm. A second girl, also 15, was not seriously injured.
Police later said that Garrison had cocaine in his system and more than twice the legal blood-alcohol level at the time of the crash.
Garrison is also being represented by Richard Hutton, who is Paris Hilton's lawyer.

Brandy did nothing morally wrong. She didn't get drunk or high and drive. She just didn't pay attention to the road for a minute and she had an accident. It's the equivalent of tripping. You don't pay attention for a minute and you make a misstep. It happens. That is *completely* different than getting high or drunk and planning on driving a car afterwards with complete disregard for the lives of others.
Yeah, Brandy caused an accident but she didn't do anything immoral or criminal. We recognize that no everyone pays attention to the road all the time, but that isn't a crime. Getting drunk/high and driving is. Blowing off a court order and the rule of law is a crime. Paris and this guy acted as if they were above the law and now they have to pay for it to learn a lesson.
But he killed someone. He should feel guilty. He shouldn't be praised for pleading guilty and feeling remorse.
Yes, no shit he killed someone. And instead of playing the celeb card, he's admitting he did it. I'm not condoning that he killed someone, but at least he's not whining about it.

Also, I'm not going to defend Paris here, but she was barely over the legal limit and no one was injured, it is not even close to the same as being near twice the legal limit, on coke, with three teenagers in the car that you supplied alchohol to and then killing one. And Brandy's was an absolutely freak accident, no circumstances of negligence on her part have been show yet, sometimes shitty things just happen. You can't compare the two.
