A Nelly Furtado track produced by Timbaland a rip-off?

Finnish tabloids Iltalehti and Ilta-Sanomat reported on 15 Jan that a track called "Do it" on Nelly Furtado's latest album "Loose" bears a striking resemblance to a track called "Acid Jazzed Evening" by a Finnish artist Tempest, a.k.a. Janne Suni. "Do it" is produced by one of the most succesful hip-hop producers in the world, Timbaland a.k.a. Timothy Mosley. On his website Suni writes, concerning the incident: "In early August 2000, I, Janne Suni, released a song called Acidjazzed Evening under the moniker Tempest in the oldschool music competition at one of the largest demoparties, Assembly. The original format of the song is MOD, a module format originated on the Amiga computer. In the music competition it got 4249 points from the voters, placing 1st out of 15 qualified entries. --- I have never given up the copyrights of Acidjazzed Evening. I also have never authorized commercial use of the song." The website is located here, and you can download the track there as well.

UKScene, "The UK Demoscene’s Official Blog", wrote about the incident in an entry dated 21 December, 2006: "On Nelly Furtado’s latest album, “Loose” (produced by Timbaland), a track called “Do It” has a chip-tune style bassline and melody - one I noticed because I loved the chip-tune sound (of course!). Unfortunately, the track sounds a lot like the beginning section of a song called “Acid Jazzed Evening” by Tempest of Damage, released at Assembly 2000." On the blog you can compare the tracks: link

The tabloids speculate that Suni is worried about the costs of a potential lawsuit, as he would be against a big record company, and considers letting the matter go. Apparently, he will consult a legal expert before making the final decision.

The track was written for an "oldschool" demo contest, it's played on a format that originated from the Amiga computer, as said on Tempest's website, hence the amateurish sound.

Just because you possibly do something better, it does not give you the right to steal someone else's work.

it doesnt surprise me- you would think that all the possible sounds that could ever be made have already been made by someone- so i dont see how people actually could make 'original' music that sounds nothing like anything anyone else has ever done..
